Well, I just found out last week that I have to have surgery in January! Fun... Now it looks like I won't be able to start working again until April.
I called all of our creditors to update them on the situation. Now I am debating if I want to continue making small payments to everyone, or just stop altogether. From everything I've read, it seems like once they start the process to sue, it would be at least 60 days before garnishment took place (what a thought!).
It's occurred to me that if they are able to garnish DH's wages for a month and a half before we file, we could survive that, but not if they garnish our bank account, because that's where the tax refund will be!! Silly me, we do have a new bank account since the move, but since I pay the CC's by check, they have the account number!!
So now I've realized I need to open a new account at another bank and use that for direct deposit of paychecks and our whopping tax return that we'll be getting. My thought is that I would use the existing account only to pay the cc bills - or, if I'm just going to stop paying them anyway I could just leave a few dollars in that account until the BK is done? Ugh, I guess I have to go figure this out now.
I realized later that I only need to change bank accounts again if I get served, and then really only so they won't know where I bank! I figure the worst they can do is garnish 25% of DH's net wages, but the attorney we are hiring on Tuesday says he has good strategies for delaying judgements.
I have a feeling the CC companies have seen their last checks from me, I'm waiting to see what the attorney tells me on Tuesday. So, if they do sue me, and I change banks again, they can garnish wages, but not the account if they don't know where it is... I think lol.
