I fired on attorney for not filing chapter 13 in over 3 months. We recently hired a new one. We voluntarily gave back 2 secured items(rv and atv's) and have a deficiency . Our foreclosure date is January 25 and we live in a non -recourse state with only one loan but 100k underwater. We had 2 offers and both were rejected in Aug. but had moved to a rental in July. I now have a chance to work a second job and pay extra on debt. We can pay all debt now but not if the bank sues us for a deficiency balance. WHAT SHOULD WE DO? Pay most of our debt off and wait to see if they sue us OR not work a second job and just pay the 600-800 for 60 months.
