We are really in the hole at this point. we have tried taking out a hardship withdrawal plan and talking to a credit counseling company who basically told us we need to talk to a lawyer. we make 120,000 a yr and our house payment is 2300.00, car pay 650, 2nd home eq 500 and a camper which is 450 a month. we also got suckered into a timeshare which is 150 a month. we have 95,000 in unsecured debt. we were basically borrowing from Paul to pay Peter ( or however that saying goes) and it just got completely out of hand. we have taken out loans on our 401k to help us make the monthly payments but now that all of that money is gone we are at a dead end and can't afford to pay the CC payments. Has anyone with an income of over 100k been able to file a chapter7 or do they always make you file a 13? and how does that all work. I have heard horror stories that with chapter 13 that it's like basically ramen noodles and water for food, etc. because they look at what your yrly salary is instead of your bring home.Tags: None
