I need some advice...
My husband filed a chapter 13 bankruptcy last November, I did not file. His attorney said they might want the tax returns, and if they did, the courts would put a hold on them. He said we would never recive a check... We file a joint return, with an injured spouse claim, on the advice of our tax preparer. I just recived a letter from the trustee, that says, he did not recive a tax return from my husband and the plan is now needing to be extended longer than the 45 months. I have tried to call the attorney, and see if my portion of the taxes should pay my husbands debt, he has no clue. I have called the courts, the trustee, two other attorneys......What can we do? I do not want to hand over MY taxes to pay for his debt. One attorney said, " they won't ask you for the money, but they can make him ask for it, since it will be considered "extra" income" So what do spuoses do when their spouse is in active Chapter 13 bankruptcy, how do the file taxes? We have four small children, my husband is a concrete worker, the tax returns help us to survive the winter....Thanks for all your help.Tags: None
