Even though I (just barely) qualify for a Chapter 7, my lawyer suggested a Chapter 13 in order to do a lien strip. Our first is 400K, our second is 106K and the house is worth 365K.

Can a judge "convert" or "force" me into a chapter 7 if my low income qualifies?

My lawyer also said that since I am below the means test for my family size and state, my budget will consist only of lawyers and trustee fees since, by definition, I do not have "disposable" income. Is that correct?

Finally, if during the ensuing three years my income goes up above the means test and I DO have disposable income, does all my disposable income go to my creditors? I believe I have to report my income on an annual basis during Chapter 13, right?
