My husband was working a job he hated and was way overqualified for, that paid very little when we filed bankruptcy.
He had been looking for a new job, basically since the day he started his job. However, the environment at work in the six months up to filing was particularly toxic and we were both very anxious for him to find a new job and get out of that company.
About a month or two before our discharge my cousin convinced my husband to apply for a job with her company. Her department had an opening. It was with a credit card company. It occurred to us that the bankruptcy may be a problem but we figured; nothing ventured - nothing gained.
Well, my husband got the first interview, and the second interview and things seemed to be going well. Then we got a packet in the mail. It was a letter saying that due to information in my husband's consumer report they had made a preliminary decision not to hire him. His credit report was enclosed with the bankruptcy circled. There was a number of someone to call if we had any questions.
We immediately did two things. One - my husband decided to give the contact person in the letter a telephone call the next week to talk to them about the decision. Two - we called our lawyer.
Our lawyer got back to us immediately. He told us that he was on vacation, but wanted to meet with us as soon as he got back. That certain case law does hold that the bk code prohibits discrimination in hiring based on a past BK.
In the meantime my husband called the contact person for the job. He was told that the decision not to hire him was only preliminary at that point in time and was invited to give her any information that he thought would change their minds. He basically told them that we had gotten in over our heads, that we had filed bankruptcy, that the bankruptcy was now discharged and that we pay all our bills on time.
She told him that she would get back to him on Monday with decision.
On Monday, my husband got a call from the company. They wanted him to come down and fill out an application because that evidentially hadn't been done at the time of either interview. My husband told me that as part of the application he had to sign a form authorizing a background a credit check.
So really the company really screwed up by checking his credit prematurely. However, I'm sure they could have gotten around that based in the fact that he has filled out applications for that company in the past.
However, we never had to pursue any further action as they called and offered him the job.
He has worked there for a year now and loves his job.
