Hello...I'm preparing to file for chapter 13, took the mean test and passed. I'm very scared and need to know some info before I decide what would be the best. Here are my questions below...
Chapter 13:
-Do I need permission if my car has major breaks down to fix or to buy a new one?
-Do I need permission to refinance my mortgage?
-Do I need to submit tax returns and refunds to trustee every year?
-Do I need to tell my company's HR about filling chapter 13?
-Do I lose my company's corporate Amex card (I do lot of travel for my job and company requires to pay all expenses by corporate card)?
-Do I need to tell trustee every year if I get raise or bonus?

- It would depend on your Trustee, but doubtful if you're going to be allowed to purchase anything on Credit during your Chapter 13 Plan. Think of possibly making a purchase prior to filing. (Make it a few months)
- I would refinance prior to filing. Once you file BK, things are going to be a little tough for a while.
- Tax Returns and Refunds are dealt with differently from State to State, Trustee to Trustee. (From what I gather)
-Yes, you will have to tell your company about filing Chapter 13, in addition to your Trustee sending a letter requesting garnishment for payments for you "Plan" (Unless of course you are Self-Employeed, which I take it you're not because you mentioned Company's HR)
-The Corporate AMEX? I've read and heard different things. From what I know, mine is still working. It was authorized by my Company, but I get the bill and pay for it Month to Month. So far so good with mine. I do know that when I logged online to my Amex website to pay the bill, the (2) Personal Amex Cards were Suspended but not the Corporate Card. So, I guess it all depends on how you were set up with getting the card. Mine does not show up on my Credit Report. So, you may want to check that.
-Telling the Trustee about Raises and Bonus, I'm just going to go with the flow. If I am asked for information I will provide it, until then I'm going to keep my mouth shut and live by the "Plan" and budget submitted and confirmed by the Court.
