Now we have a decision to make 13 or 7
So we had our second meeting with our attorney yesterday and he said that what he had to say we might not want to hear. Naturally we got ourselves prepared for the worst. It's not as bad as we thought. Turns out that we are (according to our attorney) prime candidates for a Chapter 7. We were planning on a Chapter 13 because of the possibility of cramming down an auto loan but turns out it wouldn't have helped.
The plan is to crunch some more numbers this weekend and decide for sure which chapter we are going to go for.
If we decide to do the 7 we will work on getting my DH a different much cheaper car with better gas mileage (of course). Once we do that, we will drive his current car to the dealership and give it back to them. And then sit tight for a few months to regroup, I'm ill at the thought of all those creditor calls in the meantime but my attorney says that we are months away from anybody trying to file suit against us, we are not even 60 days on some of them. Yet we get 20 some calls a day, and we don't even have that many accounts. I see some numbers 3 and 4 times a day.
If we decide to do the 13, which I doubt at this point we don't really have to do much of anything but file and do our waiting and meetings and class and pay the trustee.
It certainly rocks the boat to think you are all ready to file and have to change your whole outlook on the matter, Plus I have been reading all the stuff about 13s and almost none of the 7 stuff, lol, I guess I have my work cut out for me this weekend.
